Komby Terms of Service

These Terms of Service apply to your use of Komby, including the Komby app, getkomby.app, and related services.

By creating a Komby account and accepting these Terms, you enter into an agreement with Trofsof Group B.V.
This English text is a translation of the Dutch original for convenience. In the event of any inconsistency, the Dutch version prevails.
1. Komby
Komby is a video-first platform that allows adults to discover other people and form intentional connections.
Komby may offer functionality including:
- romance;
- friendship;
- networking;
- profile videos;
- Discovery;
- compatibility;
- connection requests;
- active connections;
- messaging;
- paid digital features.
Functionality may change over time.
2. Age requirement
You must be at least 18 years old to use Komby.
By creating an account you confirm that:
- you are 18 years of age or older;
- you are legally competent to enter into an agreement;
- the information you provide about your age is accurate.
Komby may restrict, investigate or remove accounts suspected of belonging to minors.
3. Creating an account
Depending on the available functionality you can create an account with:
- email;
- Google;
- Sign in with Apple.
You are responsible for reasonably securing your account.
You may not:
- sell your account;
- transfer your account;
- create an account for someone else without their permission;
- impersonate another person.
Notify us as soon as possible if you suspect unauthorised access to your account.
4. One personal account
A Komby account is personal.
You may not create accounts at scale, use bots, or employ technical means to circumvent account restrictions.
We may take measures against duplicate or abusive accounts where necessary to protect Komby or other users.
5. Profile information
You are responsible for the information you place on your profile.
Profile information must:
- be reasonably accurate;
- not be misleading;
- not infringe the rights of others;
- comply with these Terms;
- comply with applicable law.
We do not guarantee that all information provided by other users is accurate.
6. Video-first profile
Komby is designed around the profile video.
A profile video may be used to give other users an impression of:
- what you look like;
- how you speak;
- how you present yourself.
You may only upload media for which you have the necessary rights and permissions.
7. Your content
You in principle retain the intellectual property rights to original content you create yourself.
By uploading content to Komby you grant Trofsof Group B.V. a non-exclusive, royalty-free licence to:
- host;
- store;
- process;
- transcode;
- technically reproduce;
- moderate;
- display to authorised users;
your content to the extent necessary to provide, secure and operate Komby.
This licence in principle ends when the content is deleted, subject to:
- temporary technical backups;
- legal retention obligations;
- necessary enforcement records;
- legal claims.
8. Third-party content
You may not upload or share content for which you do not have the necessary rights.
This includes copyrighted material, and photos or videos of other people without appropriate consent.
9. Prohibited content and conduct
You may not use Komby for, among other things:
- harassment;
- threats;
- stalking;
- hate speech;
- discrimination;
- threats of violence;
- sexual exploitation;
- sexual content involving minors;
- grooming of minors;
- fraud;
- scams;
- impersonation;
- spam;
- unsolicited commercial outreach;
- sale of illegal goods or services;
- malware;
- phishing;
- collecting or publishing personal data without a lawful basis;
- circumventing blocks;
- circumventing bans;
- scraping;
- unauthorised bots;
- manipulation of Discovery or matching;
- abuse of reporting functionality.
We may publish additional rules of conduct in Community Guidelines.
10. Media moderation
Komby may automatically analyse uploaded media.
For videos, representative frames may be checked with automated safety technology.
Where content is likely to breach our rules, Komby may, among other things:
- remove content;
- block content;
- flag the account;
- perform human review;
- restrict the account;
- suspend the account;
- terminate the account.
Automated systems can make mistakes.
Users can therefore also report content or accounts.
11. Reports and blocks
You can report and block other users.
A block may, among other things, mean two users:
- no longer see each other in Discovery;
- can no longer send each other new messages;
- can no longer perform certain interactions.
A report may be reviewed by our moderation systems and/or human moderators.
Abuse of the report function is not permitted.
12. Moderation decisions
Where we reasonably determine that content or conduct breaches:
- these Terms;
- Community Guidelines;
- applicable law;
we may take proportionate measures.
These may include:
- a warning;
- content removal;
- a temporary restriction;
- a temporary suspension;
- a permanent ban.
Where applicable law requires it, we provide information about the reason for a moderation measure and available options to challenge it.
13. Discovery
Komby uses a Discovery system to show profiles to users.
Signals used may include:
- location and distance;
- intent;
- user preferences;
- compatibility;
- eligibility;
- blocks;
- safety restrictions.
Komby does not guarantee that:
- you will see every suitable profile;
- a specific person will be shown to you;
- profiles will appear in a specific order.
We may change the Discovery system.
14. Location
Komby may use location data to find relevant users near you.
Other users do not directly receive your exact GPS coordinates.
Distances are approximate and may differ from your actual physical location.
You may not use location functionality to stalk, follow or intimidate other people.
15. Compatibility
Komby may offer a Compatibility Quiz and a Compatibility Score.
Compatibility may be based on factors such as:
- values;
- communication;
- social preferences;
- lifestyle;
- emotional preferences;
- handling of conflict;
- future expectations;
- intent.
A Compatibility Score is only a product-level indication.
It is not:
- a medical assessment;
- a psychological diagnosis;
- a scientifically proven prediction;
- a safety score;
- a guarantee of attraction;
- a guarantee of relationship success.
Always use your own judgement.
16. AI
Komby may use artificial intelligence for, among other things:
- compatibility reasoning;
- expanded Compatibility Reports;
- icebreakers;
- supporting text functionality.
AI output can be:
- inaccurate;
- incomplete;
- inappropriate;
- missing context.
AI output does not constitute professional advice.
17. Connection requests
Users may request to connect with other users.
A connection only comes into existence once the required interaction or acceptance has taken place.
A request does not grant any right to a response or acceptance.
Other users may reject a request without stating a reason.
18. Active Connections
Komby may limit the number of active connections.
The maximum permitted number can be part of the core design of the service.
When your limit is reached, Komby may prevent an additional connection from being accepted until an existing connection spot becomes available.
19. End connection
You can end an existing connection.
This may have consequences for:
- the Active Connections list;
- future interactions;
- messaging functionality;
- availability of a connection spot.
Ending a connection does not necessarily immediately remove all existing technical or legally retained data.
20. Messaging
Certain connected users can send each other messages.
Komby chat is currently not end-to-end encrypted.
Do not use messaging for:
- harassment;
- threats;
- spam;
- fraud;
- illegal transactions;
- unwanted sexual content;
- distribution of malware.
21. Offline contact
Komby may put users in touch with each other, but we have no control over conduct off the platform.
You are responsible for decisions about:
- sharing personal information;
- offline meetings;
- transport;
- meeting locations;
- contact outside Komby.
Be careful when meeting someone for the first time.
22. No guarantee about other users
Komby does not guarantee that a user:
- is trustworthy;
- is safe;
- is honest;
- is single;
- has a particular identity;
- has a particular occupation;
- actually holds the intent shown on the profile.
A verification badge, if any, only means that certain checks associated with that badge have been performed.
It is not a guarantee of safety or trustworthiness.
23. Paid functionality
Komby may offer paid digital functionality.
The precise price, content and terms are shown before purchase.
Examples may include:
- Compatibility Deep Insights;
- See Who Liked You;
- Travel Mode;
- other future digital features.
The price shown at actual checkout or via the relevant platform prevails.
24. One-off purchases
Where a feature is described as a one-off purchase it is not automatically a subscription.
For example, a Compatibility Deep Insights Report may be offered as a separate purchase for a specific compatibility combination.
The concrete scope of the unlock is shown before purchase.
25. Subscriptions
If Komby offers subscriptions in the future, the following will be clearly shown before purchase:
- price;
- billing period;
- automatic renewal, where applicable;
- how to cancel;
- relevant terms.
A one-off purchase is not converted into a subscription without clear prior information.
26. Apple purchases
Digital purchases on Apple platforms may be processed via Apple In-App Purchase / StoreKit where that is used or required for the purchase or storefront in question.
Apple may be responsible for:
- payment processing;
- billing;
- purchase history;
- certain refund processes.
Apple's additional terms may apply to such transactions.
27. Stripe
For certain permitted web or other payment flows Komby may use Stripe.
Stripe may process payment data under its own terms and privacy policy.
Which payment method is offered may depend on:
- platform;
- storefront;
- product;
- applicable platform rules.
28. Right of withdrawal
Consumers in the European Union may have statutory withdrawal rights.
Special rules may apply to digital content or digital services where:
- performance begins during the withdrawal period;
- the consumer expressly consents in advance to immediate performance;
- where legally required, the consumer acknowledges that the right of withdrawal may thereby lapse.
Where this exception is applied, this must be correctly reflected in the relevant checkout flow.
A provision in these Terms does not replace any legally required checkout consent.
For purchases via Apple, Apple's own purchase and refund procedures may also apply.
29. Travel Mode
Komby may offer Travel Mode.
Travel Mode may temporarily use a different location for Discovery.
Travel Mode:
- does not necessarily change your actual home location;
- does not guarantee that users are available in the chosen destination;
- does not change existing Connections;
- does not guarantee a particular volume of Discovery results.
30. Refunds
Refund rights depend on:
- applicable consumer law;
- the payment provider;
- the nature of the purchase;
- the circumstances of the case.
Where a purchase has been processed via Apple, a refund may need to be requested via Apple's procedures.

31. Availability
We aim for good availability of Komby.
However, we do not guarantee that the service:
- is permanently available;
- operates without errors;
- is available without maintenance;
- remains compatible with every device.
Outages may result from, among other things:
- maintenance;
- providers;
- internet outages;
- Apple;
- Firebase;
- Google Cloud;
- external AI services;
- force majeure.
32. Changes to Komby
We may change Komby to, among other things:
- add new functionality;
- improve existing features;
- improve security;
- prevent fraud;
- comply with regulations;
- resolve technical issues.
Where a change has material consequences for consumers' paid rights, we respect applicable mandatory consumer law.
33. Experimental features
Certain functionality may be offered as beta, experimental or preview.
Such features may change or be discontinued.
We will respect consumer rights in relation to paid functionality.
34. Intellectual property
The rights to Komby's own:
- software;
- source code;
- brand name;
- logo;
- interface;
- texts;
- original Compatibility Quiz;
- question structure;
- algorithms;
- graphic elements;
- database structure;
rest with Trofsof Group B.V. or its licensors, where applicable.
You only receive a personal, limited, revocable and non-transferable right to use Komby in accordance with these Terms.
35. No scraping or reverse engineering
To the extent permitted by law, you may not, without our permission:
- perform scraping;
- systematically copy profiles;
- build databases from Komby data;
- use bots;
- circumvent security measures;
- misuse APIs;
- reverse-engineer for unauthorised purposes;
- use Komby to build a competing user database.
Mandatory statutory exceptions are unaffected.
36. Deleting your account
You can delete your account via the app.
The handling of personal data after account deletion is described in our Privacy Statement.
37. Suspension and termination by Komby
We may restrict or terminate an account where there is a reasonable ground, including:
- serious breach of these Terms;
- repeated breaches;
- fraud;
- serious safety risks;
- minority (under age);
- ban evasion;
- illegal activity;
- a technical attack on Komby.
Where reasonable, we apply proportionate measures.
38. Privacy
Our Privacy Statement describes how we process personal data.
It forms an important part of the information that applies to your use of Komby.
39. Liability
Nothing in these Terms limits or excludes liability where this is not permitted under mandatory Dutch or European law.
To the extent permitted by law, Trofsof Group B.V. is not liable for damages arising solely from:
- the conduct of other users;
- incorrect information from other users;
- personal choices made following a Compatibility Score;
- offline meetings;
- circumstances beyond our reasonable control.
We are not responsible for the success or failure of personal relationships that arise through Komby.
This provision does not affect statutory consumer rights.
40. Personal responsibility
Komby is a tool for meeting people.
Users remain personally responsible for:
- their interactions;
- their safety;
- information they share;
- decisions to meet someone;
- decisions based on AI or Compatibility.
41. Force majeure
To the extent permitted by law, we are not liable for non-performance caused by circumstances beyond our reasonable control.
These may include:
- major internet outages;
- power failures;
- natural disasters;
- war;
- government measures;
- outages at essential cloud providers.
42. No waiver of rights
If we do not immediately enforce a provision, that does not mean we waive our rights.
43. Invalid provisions
If a provision of these Terms is wholly or partly invalid or unenforceable, this does not affect the remaining provisions.
The relevant provision will, to the extent possible, be applied in a way that approximates its original purpose within the limits of the law.
44. Transfer
We may transfer the rights and obligations under this agreement in connection with, for example:
- reorganisation;
- merger;
- acquisition;
- sale of Komby;
to the extent permitted by applicable law and where statutory consumer rights are respected.
You may not transfer your account or agreement to another person without our permission.
45. Changes to these Terms
We may change these Terms where there is a valid reason, for example:
- changes to Komby;
- new functionality;
- changes in legislation;
- new safety requirements.
In the case of material changes we inform users in advance where required by law.
Changes are not applied retroactively where this would affect statutory consumer rights.
46. Governing law
This agreement is governed by Dutch law.
If, as a consumer, you reside in another EU or EEA member state, this choice of law does not deprive you of the protection of mandatory consumer rules that apply to you under applicable private international law.
47. Disputes
If you have a complaint or dispute, we ask that you first contact us at [email protected].
We will try to resolve a reasonable dispute directly where possible.
Nothing in these Terms limits the right of a consumer to bring a dispute before a competent court where the law grants that right.
